Caltrans Is Paying Millions in Injured Worker Case

Construction injuries happen in a variety of ways

We have learned that Caltrans will pay $37 million to settle a lawsuit that paralyzed a construction worker eight years ago. The California Department of Transportation settled with Kyle Anderson, the many paralyzed. He was 20 years old at the time of the incident.

“This preventable incident irreparably changed the lives of Kyle and his parents, Matt and Robin Anderson,” said his attorney. “This settlement will help ensure that Kyle will receive the 24/7 medical care he requires.”

Kyle was working for All Phase Excavating on a Caltrans wiring project. While he was crouched in a trench, a driver crossed onto the road shoulder and hit him. Caltrans approved a lane closure for the site that night, but a resident engineer denied the request and even ordered a backhoe near the site to be removed to keep the lane open. Instead, a traffic light was put up in its place, but the light was positioned so that it shined into the eyes of oncoming drivers.

Anderson is completely paralyzed. He has also been diagnosed with “locked in” syndrome, a condition in which a person is conscious and aware of their surroundings but unable to communicate.
