How do you determine pain and suffering for an auto accident? Determining pain and suffering from an auto accident can be difficult. It’s not necessarily something you can put a price tag on or measure out in numbers. To determine pain and suffering from an auto accident, you have to look at your client’s life. You have to talk to the individuals in their life. Whether it be the kids, or the mothers, or the fathers, the girlfriends, wives, husbands, boyfriends. You talk to those individuals in your client’s life.

You find out what they used to be able to do versus what they can no longer do. On top of that, you have to get a feel for what their emotions are like now compared to how they were before. After a traumatic event, a client can be depressed, anxious, or not able to sleep. Usually, they can identify this themselves, but sometimes you have to look closely, on top of hearing what their loved ones have to say about their own observations.

As a trial attorney in personal injury cases, it’s where you really learn how the art of words shows your client’s pain and suffering in the courtroom. While documentation is important, from medical bills to lists of a client’s missed activities, it’s the words that really paint the picture of what’s happened. Through words, you describe for a jury what the pain and suffering are for your client. Before you start, you first have to bring the family and friends of your client. This means letting them testify to be able to say those words in the courtroom. As a result, it’s important to let them tell the jury how they’ve seen your client’s life affected.
