Nail Gun Accident Uncovers History Of Violations

A California house-framing contractor has been fined $225,000 in penalties by Cal/OSHA for multiple violations of nail gun safety. They began investigating because of an incident that happened earlier this year when an employee was injured. The investigation has uncovered 34 similar injuries since 2016.

In this incident, the worker was carrying the nail gun in his right hand with his finger on the trigger. The nail gun was unintentionally discharged into his left arm.

Cal/OSHA discovered that the contractors failed to train workers on proper use of the nail guns and failed to ensure the safe operation of the tools.

“Employers must effectively train workers to safely operate dangerous tools such as nail guns,” Cal/OSHA Chief Juliann Summ said.

At the Simpson Law Group, we know that this is just one of the many ways in which constructions workers can be injured on the job. If you need a San Diego construction accident attorney, we will be by your side, working to secure the compensation you need.

What Can Happen?

As you can see from the story above, construction companies often contribute to situations that cause their employees harm. Employers have a duty to ensure that their employees are properly trained on all dangerous equipment before they begin working.

They should also ensure that basic construction site safety is covered to prevent accidents.

Companies need to provide workers with proper safety equipment so that they are well protected. This includes:

  • Proper clothing
  • Footwear
  • Protective eyewear
  • Helmets
  • Gloves

Any employee working around hazardous airborne materials needs to be provided with proper respiratory equipment. We know that there are many respiratory illnesses that can develop due to workplace conditions.

Often, companies bring in third party contractors to perform work on a construction site. These contractors may not adhere to the same safety standards and this could cause harm to workers. If you are harmed by a third party, you may be eligible to file for claims beyond workers’ compensation.

OSHA lists the four most fatal construction accidents as the following: falls, electrocutions, getting struck by an object, and getting caught in between objects.

The construction industry continues to be one of the most dangerous in the country, which is why employers should take all necessary steps to increase worker safety and reduce incidents or injuries.
