What happened with this case?

We have learned that a man has recently filed a lawsuit against Delta Air Lines and a dog’s owner after an incident that took place on a flight from Atlanta to San Diego.

Marlin Jackson says that he had just taken a window seat on a 2017 flight when a dog sitting on the lap of the passenger beside him lunged for his face and pinned him against the window so he could not escape. The lawsuit says that Delta “took no action to verify or document the behavior training of the large animal.” The complaint also says that the dog’s owner should have known that a dog of that size was foreseeably dangerous.

Jackson needed 28 stitches as a result of the incident.

Following the attack, Delta changed their policies regarding emotional-support and service animals. They now require passengers to provide “confirmation of animal training” as well as proof of an animal’s immunization records before a passenger can bring a dog on board.

Do these incidents happen often?

Admittedly, statistics on in-flight animal bites is lacking. However, we do know that there are around 4.5 million dog bites in the US each year.

  • The CDC says that around one of every five dog bites requires medical attention.
