We know that the recent stories about asbestos being found in baby powder likely has you on edge. It is scary to find out that you could have been using a product that is contaminated for years. Now, we are learning that the FDA has confirmed that two stores, Claire’s and Justice, have carried makeup products that contained asbestos.

At the Simpson Law Group, we are here to answer your questions about defective products. Many people are shocked to learn just how many product recalls there are in this country. If you or a loved one are injured due to a product used or consumed, you need to know where to turn. When you need a San Diego product liability attorney, you can count on us to be by your side.

What Happened In This Case?

We are still learning about the FDA’s findings, but they recently released test results on products tested at both companies. The results show that three powdered makeup products from Claire’s and one from Justice contained asbestos. If you will remember correctly, asbestos exposure can cause lung disease.

Even scarier is that, according to the FDA’s statement, Claire’s “refused to comply” with the request to recall the items that tested positive.

Following the announcement, Rep. Frank Pallone, D-N.J., is going to push for legislation that would allow the FDA to make recalls in the cosmetic industry similar to the way it can with food products.

Other Faulty Products

Many people are shocked to learn just how many faulty products make it to the market shelves. If you look at the government website that tracks current recalls, you will see hundreds of items across many industries on the list. No industry is spared and the problems go far beyond the stories of exploding batteries and cars catching on fire that make it to the nightly news.

We know that most problems occur in one of three ways:

  1. There is a faulty design that causes the product to be unsafe for consumers
  2. A manufacturing error alters a product from its original design and makes it harmful for use.
  3. The product is improperly labeled, which can mean a range of things. It can include leaving off ingredients, warnings, and hazards. It can mean that medication does not have the proper dosage listed or leaves off side effect warnings.
